One cannot measure the impact of one's individual choices by a swinging of the arms. The outdoors are not infinite; and public space must be shared equally. The measure of one's freedom must therefore be counterbalanced with consideration for everyone else's. If one swings an arm outward and strikes someone else in the face, the "swinging arm" is far more at fault than the "struck face."
Conscientiousness is always required. And where children are involved, even private spaces become of public concern. Any behavior that endangers the lives of children, even just by depriving them of their primary parental figure, is justification for intervening in the better interests of the children.
